ODP Announcement 22-007 informs providers that the new Fee Schedule Rates and Department-established fees are anticipated to be visible on Individual Support Plans (ISPs) in HCSIS on February 14, 2022.

The anticipated effective date for the increased Fee Schedule Rates is January 1, 2022; however, the effective date in the Home and Community Services Information System (HCSIS) will be February 15, 2022. The anticipated effective date for the Department-established fees for residential ineligible services is July 1, 2022, and HCSIS will reflect the same effective date. Both the Fee Schedule Rates and Department-established fees for residential ineligible services will be visible in HCSIS on February 14, 2022.

Of note, on January 6, 2022, the P/FDS cap was increased to $41,000, and the Community Living Waiver cap was increased to $85,000.

This communication provides guidance and addresses Individual Support Plan (ISP) related impacts.

ODP Announcement 22-006 is to inform all Waiver Providers and Vendors whose last digit of their Master Provider Index (MPI) number is 3, 4, or 5, as well as new providers who enrolled in the 2020–2021 fiscal year, that they must submit their qualification documentation to their Assigned AE and/or the Office of Developmental Programs’ (ODP) Bureau of Supports for Autism and Special Populations (BSASP). This documentation is due between February 1, 2022 and March 31, 2022

Documentation must include a completed DP 1059 form and/or DP 1088 form, Provider Qualification Documentation Record (providers must use the most recent version found on MyODP), and any other required supporting documentation. For reference to provider qualification, please see Pennsylvania Bulletin Volume 49, Number 40, Subsections 6100.83-84, which contains provider qualification citation specifications.

ODP Announcement 22-005 describes the Office of Developmental Programs’ (ODP) Provider Qualification Process and outlines the steps the Assigned AE and provider must follow to meet these requirements. It also outlines the steps Supports Coordinators (SCs) take to transition individuals if needed. This communication does not describe the qualification process for SC organizations. The qualification process for Providers enrolled in the Adult Autism Waiver can be found in ODP Announcement 20-110.

ODP Announcement 22-003 shares that ODP and Temple University are conducting CI Friday Forums. These forums are an opportunity for current CIs and other interested parties to receive up-to-date information about the incident investigation process. The session dates and topics are:

  • February 11, 2022 — Peer Review: Year in Review
  • April 8, 2022 — Administrative Review Overview
  • June 10, 2022 — Topic to be announced (Save the Date)

There will be two sessions available on each date. One session will be hosted in the morning from 10:00 am–11:30 am, and the second session will be hosted in the afternoon from 1:00 pm–2:30 pm. The same topic will be covered in each session.

Seating is limited, and you can only sign up for one forum session per date. Participants can submit questions prior to the session until close of business (COB) the Friday before the scheduled Forum.

Registration for February 11, 2022, is now open and will close at the end of the day on February 9, 2022. See the announcement for registration details.

ODP Announcement 21-095 discusses the availability of a 30-day public comment period for the proposed fee schedule rates for services funded through the Consolidated, Community Living, Person/Family Directed Support (P/FDS), and Adult Autism Waivers as well as Base-funded programs. Changes to the Remote Supports Component of Assistive Technology in the Consolidated, Community Living and Person/Family Directed Support (P/FDS) Waivers

ODP Announcement 21-094 notifies interested parties of changes to Remote Supports in the most recently approved waiver amendments, including the requirement to complete the Variance Form (DP 1086) when an individual needs more than $5,000 of Remote Supports per fiscal year.

Amendments to the Consolidated, Community Living, and P/FDS Waivers approved by the Centers for Medicare and Medicaid Services (CMS) effective November 22, 2021, contain changes to Remote Supports which are a component of the Assistive Technology service (all requirements contained in the waivers prior to the amendments continue to apply). The Office of Developmental Programs (ODP) has updated Variance Form DP 1086 and the related instructions originally found in Bulletin 00-18-06, Variance Form and Process, to reflect the requirements for intensive remote supports in these amendments.

ODP Announcement 21-093 is a reminder to all providers and vendors that provider revalidation occurs every 5 years from the initial enrollment date or most recent revalidation date of every service location. The Office of Developmental Programs (ODP) is seeing an increase in claim denials because providers fail to revalidate their service location(s) on time.

NOTE: If an MA or base provider does not complete revalidation by their revalidation date, they will not receive payment for service locations that are end dated and closed in PROMISe™. Claims will be denied and show as denied on their remittance advices. Reactivation of closed sites will be required prior to billing/payment resumption.

ODP Announcement 21-091 provides notice that the Federal Supplemental Security Income (SSI) payment will increase beginning January 2022. Effective January 2022, the SSA increased the SSI allotment by 5.9 percent to reflect an increase in the cost of living. This raises the maximum monthly income to $841 for an eligible individual, $1,261 for an eligible individual with an eligible spouse, and $421 for an essential person. There is no anticipated increase in the State Supplementary Payment (SSP) for 2022.

To account for the new COLA, Room and Board contracts should be reviewed to determine appropriate adjustment for those living in homes operated by Residential Habilitation or Life Sharing providers who collect room and board fees from individuals enrolled in the Consolidated, Community Living, and Adult Autism Waivers and providers of base-funded residential habilitation and life sharing services.

SSI is a federal program that provides benefits to adults and children who meet the SSA’s requirements for disability, income, and resources. This income benefit is designed to help qualified individuals meet basic needs for food, clothing, and shelter. Periodically, a COLA affects the maximum monthly allotment.

The Room and Board Contract (DP 1051) is found on MyODP.org at the following path: Resources > Intellectual Disability > Forms. Office of Developmental Programs. Beginning July 1, 2020, the requirements for Room and Board as established in 55 Pa. Code Chapter 6100 must be followed.

ODP is in the process of replacing the DP 1051 form to reflect Sections §§6100.681–6100.694 that providers will begin to use. The current DP 1051 will continue to be accepted as current until the annual due date or until a change requires that a new form is completed.

ODP will be releasing a bulletin to stakeholders regarding the new room and board requirements with the 6100 regulations. This bulletin will also inform stakeholders of the new form and where it can be found on myodp.org.

ODP Announcement 21-081 informs providers that the Heightened Scrutiny Onsite Tools for Non-Residential Service Locations has been finalized and posted for stakeholders to view. The Office of Developmental Programs (ODP) is also using this communication to address some of the comments and concerns that were received through public comment.

While the COVID-19 pandemic resulted in significant delays in performing the onsite visits, ODP will now be continuing with the Heightened Scrutiny process for Community Participation Support (CPS) and Day Habilitation service locations to meet the CMS requirement that all waiver providers must be in full compliance with the Home and Community-Based Services (HCBS) Settings Rule no later than March 17, 2023.

ODP Announcement 21-080 is to inform all interested parties of the availability of the public comment webinar recordings regarding proposed changes to the Consolidated, Community Living, Person/Family Directed Support (P/FDS), and Adult Autism Waivers with an anticipated effective date of January 1, 2022.

The Office of Developmental Programs (ODP) held three webinars to discuss proposed changes to the Consolidated, Community Living, P/FDS, and Adult Autism Waivers and to obtain public comment on the proposed changes. The following webinars were recorded and are now available online along with the PowerPoint presentations utilized:

  • Consolidated, Community Living, and P/FDS Waiver webinar held November 4, 2021; and
  • Adult Autism Waiver webinar held November 3, 2021.
