ODP Announcement 047-16; Frequently Asked Questions for Targeted Services Management Bulletin Now Posted

On January 20, 2016, ODP issued bulletin 00-16-01 entitled Targeted Services Management for Individuals with an Intellectual Disability. The purpose of the bulletin was to communicate and clarify the requirements for targeted services management that were approved by the Centers for Medicare and Medicaid Services on April 15, 2015.

Since the release of the bulletin, ODP has received many inquiries from stakeholders. To address these inquiries, ODP has developed a document entitled Frequently Asked Questions (FAQs) Targeted Services Management Bulletin. Updates will be made to the FAQ document as more questions are received.

ODP has released the following:

  • Announcement 037-16: Vendor Fiscal/Employer Agent (VF/EA) Financial Management Services (FMS) Wage and Benefit Ranges for Specific Participant Directed Services (PDS) Effective July 1, 2016
  • Announcement 038-16: Agency with Choice Financial Management Services Wage Ranges and Benefit Allowance and Corresponding Department Established Fees for Specific Participant Directed Services Effective July 1, 2016
  • Announcement 039-16: PA Department of Human Services Medication Administration Training Program Critical Date Changes and Program Updates

The Office of Vocational Rehabilitation is seeking public comment on the following two memo revisions:

  1. The OVR Supported Employment Policy is a revision of the current policy titled 03-200.05 Performance Based Job Coaching.
  2. The second memo is also a procedural revision of 96-800.6 On-The-Job Training.

These documents will also be available for viewing on the Publications page on the OVR website. Please review & forward your comments by July 15.

RCPA hosted a webinar exclusively for members on June 3, Changes to the FLSA’s Overtime Rules, regarding the Department of Labor (DOL) Proposed Rule regarding changes to overtime exemption and salary thresholds. Jeffrey J. Worley, partner at the law office of Gibbel Kraybill & Hess, LLP was the presenter.

Topics of discussion included:

  • How will the changes to the FLSA impact your organization?
  • What is the new salary basis?
  • Should you convert your salaried employees to hourly employees?

Your feedback is greatly needed. The US Department of Labor (DOL) has proposed increasing the threshold related to the overtime exemption. This has caused great concern among RCPA members as there is no additional funding being proposed to cover the cost of this change. RCPA will be going to Washington, DC in June with several members to discuss this issue with PA legislators. In preparation for this visit, we are asking that this survey be completed no later than June 1, so that we have data to present in addition to our concerns. Thank you.

The Department of Human Services, under Secretary Ted Dallas, has established an IDD Fiscal Work Group over the last several months. This has been led by the Office of Developmental Programs Deputy Secretary Nancy Thaler and includes several RCPA members. The focus of this work group has been on the IDD residential rate methodology.

The Provider Revalidation Webinar, with Jamie Buchenauer from DHS, was held on Wednesday, January 6. RCPA members and invited guests received answers to many of their questions regarding the revalidation process. Also on hand to offer input and answer questions were Ron Melusky and Chuck Frick from ODP, Lisa Page from OMHSAS, and Rosemary Cosgrove from OMAP. A recorded version of this webinar is available. Time is running out; the deadline for revalidating is Thursday, March 24, 2016. Numerous RCPA members have already gone through this process, but it appears that large numbers of providers have not yet done so. A special provider revalidation webinar will be held by RCPA on Wednesday, January 6 at 10:00 am. Jamie Buchenauer, from the Department of Human Services, will be presenting the webcast.
