Act 150

The Office of Long-Term Living (OLTL) has released information about the Act 150 Program sliding fee scale for calendar year (CY) 2023. This information includes:

  1. 2023 Act 150 Sliding Fee Scale;
  2. Monthly Act 150 Participant Fee Report (Age 60 and Over);
  3. Monthly Act 150 Participant Fee Report (Under Age 60);
  4. Monthly Act 150 Participant Fee Reports (Excel Version);

Please note: the bulletin’s effective date is January 1, 2023. Collection of Act 150 participant fees based on the 2023 Fee Scale must begin on the bulletin’s effective date.

The above documents are available in alternate format upon request by calling (717) 857-3280. For future reference, a copy of this bulletin will be posted to the DHS Bulletin Results page for OLTL.

The Office of Long-Term Living (OLTL) has released a communication that provides clarification to Act 150 Service Coordination entities on the Act 150 to Community HealthChoices (CHC) Waiver Transfer procedure. This procedure outlines the steps the Act 150 Service Coordinator (SC) should take once the participant has been confirmed nursing facility clinically eligible (NFCE), and a financial eligibility determination is needed to confirm if the participant is to transfer to the CHC Waiver.

As detailed in the Act 150 Guidelines, the reevaluation process is to be conducted at least once each year within 365 days of the first level of care determination and each subsequent year.

The Department of Human Services (DHS) has announced rate increases for Personal Assistance Services (PAS) in the OBRA Waiver and Act 150 program. There will also be a rate increase for Residential Habilitation in the OBRA Waiver. These rate increases become effective on January 1, 2020. The new rates for the OBRA Waiver were published in the August 24, 2019 edition of the Pennsylvania Bulletin. The new rates for the Act 150 Program were published in the November 30, 2019 edition of the Pennsylvania Bulletin. These new rates are based on a participant’s county of residence.

In addition, Home and Community Services Information System (HCSIS) service plans were updated on November 30, 2019. Service Coordinators (SCs) do not need to make any service plan updates for this rate change, as a HCSIS system-wide update is being initiated to make the necessary service data updates onto the impacted service plans.
