ODP Announcement 21-084 announces that the renewal of the Adult Autism Waiver (AAW) was approved by the Centers for Medicare & Medicaid Services (CMS) on November 18, 2021. As communicated in ODP Announcement 21-067, the renewal of the AAW has no substantive changes from the previously approved waiver.

The renewal was submitted with no substantive changes because some previously proposed changes to the AAW conflicted with the requirements of Section 9817 of the American Rescue Plan Act and CMS guidance that was published in May of 2021. The renewal is effective July 1, 2021, and can be found on the DHS website.

Because the Office of Developmental Programs (ODP) is not making the changes it originally planned to the AAW, ODP will not be implementing the proposed rates published in the Pennsylvania Bulletin on May 22, 2021. Any new proposed changes to rates will be published in the Pennsylvania Bulletin for a public comment period prior to implementation.

The purpose of this email is to inform all interested parties that the Centers for Medicare and Medicaid Services (CMS) has granted the Office of Developmental Programs a second 90-day extension on the currently approved Adult Autism Waiver through December 27, 2021.

Questions about the extension can be directed to ODP.

This meeting will provide updates on COVID-19 activities, answer questions, and offer support. These meetings are held for all Office of Developmental Programs (ODP) providers of Adult Autism Waiver (AAW) services. The virtual office hours (VOH) start with an overview of any new ODP announcements and also include a) highlights of new practices, b) a review of topics and questions sent in advance, and c) a discussion of any concerns that have come up within the past few weeks. Providers will be able to ask questions directly of AAW Regional Office (RO) representatives.

The Office of Developmental Programs (ODP) is disseminating communication ODPANN 20-113 – “Public Comment Starts December 18, 2020 for Proposed Amendments to the Intellectual Disabilities and Autism (ID/A) Waivers and Adult Autism Waiver”. The purpose of this communication is to announce that proposed amendments to the consolidated, person/family directed (P/FD), community living, and adult autism waivers effective March 1, 2021, will be available for review and comment starting on December 18, 2020. This date will begin a 30-day public comment period that will end on January 18, 2021.

Information regarding the proposed waiver amendment changes, including how to provide comments, can be found in the Pennsylvania Bulletin, Volume 50, Number 50 published on Saturday, December 12, 2020 on this webpage.

This publication was released earlier than anticipated, and as a result, waiver documents with proposed changes are not currently available on the Department of Human Services (DHS) website. For this reason, the start of the public comment period will be delayed until December 18, 2020 when all needed information will be available on the DHS website. Another communication will be published on December 18, 2020; it will provide more information about the changes proposed in the waiver amendments and the public comment process.

ODP Announcement 20-111

The purpose of ODP Announcement 20-111 is to inform Supports Coordination Organizations (SCOs) of an updated statewide qualification process. The Centers for Medicare and Medicaid Services (CMS) requires a statewide process to ensure that SCOs are qualified to render services to waiver-funded individuals. The Office of Developmental Programs (ODP) is replacing the previous Adult Autism Waiver (AAW) SCO requalification process with the ODP AAW SCO qualification process outlined in this communication.

New SCO Requalification

Following the SCO’s initial qualification date, all SCOs classified as new are to be requalified by the end of the following fiscal year. This will be detailed on the AAW SCO qualification form (Note: This form is under development and will be distributed at a later time). For example, if a new SCO’s first qualification begin date is January 20, 2017, the SCO must be requalified by June 30, 2018, which is the end of the following fiscal year. A new SCO’s status will be updated from new to existing after the SCO is requalified.

Existing SCO Requalification Cycle

Previously, AAW SCOs were requalified during annual monitoring and the Quality Assessment and Improvement (QA&I) process. All activities associated to the AAW SCO requalification process will now occur during the ODP AAW SCO qualification process. Once an SCO is classified as existing, the SCO is to be requalified on a three-year cycle based upon the last digit of the SCO’s MPI number. The timelines for Cycle 2 of SCO requalification will be slightly different from the timelines for Cycle 2 of QA&I due to when the requalification process is starting and the corresponding fiscal year.

Deadline, as Letters on a Clock
On January 14, 2020, the Office of Developmental Programs released an updated version of the Provider Agreement for Participation in Pennsylvania’s Consolidated, Person/Family Directed Support, Community Living Waivers, and Adult Autism Waiver. Providers were informed that a signed copy of this document must be received no later than close of business on March 1, 2020.

As of February 21, 2020, many providers have not submitted their signed agreements. Failure to submit a signed agreement may impact providers’ ability to successfully submit claims for services rendered after March 1, 2020.

The Office of Developmental Programs (ODP) released notification on Tuesday, January 14, 2020 of the new Provider Agreement for Participation in Pennsylvania’s Consolidated Waiver, Person/Family Directed Support Waiver, Adult Autism Waiver and Community Living Waiver (“Waiver Programs”) that will serve as the statewide “Provider Agreement” between providers of waiver-funded services and ODP, the Department of Human Services, as the Pennsylvania State Medicaid Agency effective January 1, 2020.

This letter from ODP Deputy Secretary Kristin Ahrens was not included in the original distribution. The letter provides further clarification on the applicability of the new Provider Agreement and includes a due date for submission of the signed agreement. In addition, the Provider Agreement Form and Instructions have been updated. Every waiver provider must complete an agreement.

  • The legal entity of each waiver provider is required to submit only one agreement for that legal entity, regardless of the number of services provided or the number of service locations operated by the legal entity.
  • Each agreement must include the original signature of the provider’s Chief Executive Officer/Director/Owner.
  • Please also provide a copy of your agency’s IRS letter 147C to verify the agency’s legal name and FEIN.
  • Completed agreements may be submitted to ODP as an attachment via email.
