ODP Announcement 21-084 announces that the renewal of the Adult Autism Waiver (AAW) was approved by the Centers for Medicare & Medicaid Services (CMS) on November 18, 2021. As communicated in ODP Announcement 21-067, the renewal of the AAW has no substantive changes from the previously approved waiver.

The renewal was submitted with no substantive changes because some previously proposed changes to the AAW conflicted with the requirements of Section 9817 of the American Rescue Plan Act and CMS guidance that was published in May of 2021. The renewal is effective July 1, 2021, and can be found on the DHS website.

Because the Office of Developmental Programs (ODP) is not making the changes it originally planned to the AAW, ODP will not be implementing the proposed rates published in the Pennsylvania Bulletin on May 22, 2021. Any new proposed changes to rates will be published in the Pennsylvania Bulletin for a public comment period prior to implementation.

ODP Announcement 21-082 announces the release of the Quality Assessment and Improvement (QA&I) Annual Statewide Report for Fiscal Year 2020–2021. The report provides QA&I review results of AEs, SCOs, and Providers and includes a summary analysis of statewide data collected during Interim Year 1 (IY1) of the QA&I cycle for the Office of Developmental Programs’ (ODP) Consolidated, Person/Family Directed Support (P/FDS), Community Living, and Adult Autism waivers.

The report highlights successes and opportunities for systemic quality improvement discovered during QA&I reviews in a streamlined, easy-to-use format. Key results are underscored in entity-specific subsections entitled “Reasons to Celebrate” and “Highlighting Opportunities.” The intent of the latter is to encourage entities to target these low performing areas with quality improvement activities.

ODP Announcement 21-083 provides some guidance to providers when determining whether an event involving staff employed by the provider constitutes alleged neglect in accordance with the Office of Developmental Programs’ (ODP) regulations such that it must be reported as an incident in the Enterprise Incident Management (EIM) system. This announcement also provides guidance about applying regulatory requirements related to complaint management when an event does not require reporting as an incident of alleged neglect.

When alleged neglect is reported for events that do not meet the criteria, it compromises ODP’s ability to identify and act on events that do constitute neglect or an allegation of neglect. When an event does not meet such criteria, providers should address and manage the event as a complaint in accordance with applicable regulatory requirements. A report of alleged neglect should not be filed when a service was not rendered due to the absence of direct care staff and the absence did not place the individual at a health or safety risk. In this circumstance, a provider should follow their complaint management process as opposed to filing a reportable incident.

ODP Announcement 21-076 announces the release of the Office of Developmental Programs’ (ODP’s) Annual Waiting List report. The waiting list is comprised of individuals who are eligible to receive services and supports through ODP’s four home and community-based services (HCBS) waivers; however, due to insufficient waiver capacity, the state cannot currently meet their needs.

In this report, you’ll find information regarding ODP’s strategies and initiatives to address the problem. The report also demonstrates the progress that has been made since 2015 to reduce the number of individuals on the waiting list. The Annual Waiting List Report 2021 is located online at MyODP.

The Office of Developmental Programs (ODP) is re-releasing Announcement 20-072 with “HCBS At-A-Glance By Level of Community Spread” to better assist stakeholders in tracking and referencing specific guidance related to ODP functions in the context of the Level of Community Spread within a County. Updates appear in red.

The At-A-Glance Guide provides a quick reference on related operational guidance and will inform providers, Supports Coordination Organizations (SCOs), and Administrative Entities (AEs) planning across multiple counties. The At-A-Glance Guide has been updated to align with the Centers for Disease Control and Prevention (CDC) COVID Data Tracker as a primary source for monitoring the level of community transmission of COVID-19. The CDC COVID Data Tracker uses four (4) levels of community transmission: Low, Moderate, Substantial, and High.

The At-A-Glance Guide addresses the following functions:

  • Compliance with 55 Pa. Code Chapters 2380, 2390, 6100, 6400, and 6500;
  • Quality Assessment and Improvement (QA&I) process;
  • Independent Monitoring for Quality (IM4Q);
  • Supports Intensity Scale (SIS™) and PA Plus Assessments;
  • Administrative Entity (AE) Processes;
  • Licensing Inspections;
  • Investigations Completed by Certified Investigators; and
  • Supports Coordination Organizations (SCOs).

The Juvenile Court Judges’ Commission, the PA Council of Chief Juvenile Probation Officers, and the JCJC Awards Committee are pleased to announce that nominations are now being accepted for the 2021 JCJC Awards Program. Award nomination forms can be found on the JCJC website. This year’s program categories for which your program may be eligible include:

Residential Program of the Year Award: Available to any public or private sector program serving alleged and/or adjudicated delinquent youth in a residential setting. This includes foster homes, group homes, residential treatment programs, general childcare facilities, shelter care facilities, detention centers, independent living programs, and other programs providing out-of-home, overnight care to children. Award Winners prior to 2016 are eligible for nomination.

Community-Based Program of the Year Award: Available to any public or private sector program, not operated by the court, which provides community based, non-residential services to alleged and/or adjudicated delinquent youth including, but not limited to, day treatment programs, in-home services, Boys and Girls Clubs, Education Services, and out-patient services

Meritorious Service Award: Available to a volunteer committed to furthering the development of at-risk, alleged and/or delinquent youth (Examples of volunteer work may include youth aid panels, youth commissions, anti-violence programs, school-based programs, diversionary programs, mentoring programs, faith-based programs, community centers or other similar programming).

As in previous years, all nominations must be submitted by county juvenile probation departments. Therefore, if you would like to have your program or volunteer nominated, please contact a Chief Juvenile Probation Officer to discuss the possibility of submitting a nomination. Formal professional award nomination materials must be submitted via email by Monday August 16, 2021.

Youth Awards: In addition, the Juvenile Court Judges’ Commission will once again sponsor a Youth Awards Program as part of this year’s Annual Awards Program to honor the youth selected as winners.  The Youth Awards Committee is accepting nominations for the Outstanding Achievement Contest and the Creative Expression Contest both of which are described below.

Please note that in an effort to recognize the expanding and creative artistic talent of youth, the Creative Expression Contest category will once again include either a Written, Poster, or Video entry in two age categories, fifteen (15) and under and sixteen (16) and over. The requirements of each nomination are listed below and included in the attached nomination forms. Please note that these forms will also be available on the JCJC website. This year’s theme is “Moving Forward in Unity”. The winners and their chaperones will be honored guests at the 2021 Youth Awards Program and Dinner. Individuals submitting nominations will be responsible for ensuring that winners attend the Youth Awards Program. Winners will have the opportunity to say a few words upon receiving their award. All youth award nominations must be postmarked by Monday August 16, 2021.

OUTSTANDING ACHIEVEMENT CONTEST:

The Outstanding Achievement Contest consists of a narrative description of a youth’s outstanding qualities of community service, victim reparation, academic accomplishments, citizenship, attitude, extra-curricular activities, peer relationships and positive changes in behavior, submitted by a counselor, teacher, or juvenile probation officer.

CREATIVE EXPRESSION CONTEST:

The Creative Expression Contest submission consists of a Poster, no larger than 22” H X 28” W with a 1” border as a picture, drawing, painting, or collage; or a Written essay, poem, story, etc. entry typed and limited to one page in length; or a Video entry on a USB Flash Drive, DVD or CD, in a mpeg, mov, wmv, mp3, or avi format of no longer than 2 minutes. This contest has a fifteen (15) and under category and a sixteen (16) and over category.

The Awards Committee encourages you to present the Youth Awards theme and requirements to the youth in your program for their participation in the contest.
