Due to the PA Office of Vocational Rehabilitation (OVR) Order of Selection (OOS) operations memorandum, effective April 1, 2025, the Office of Long-Term Living (OLTL) is providing guidance to the following entities regarding the referral of participants to OVR:

    1. Managed Care Organizations (MCO);
    2. Service Coordinators (SC);
    3. Service Coordination Entities (SCE); and
    4. Service Providers.

OVR recognizes three (3) disability categories:

    1. Non-Significant Disability (NSD);
    2. Significant Disability (SD); and
    3. Most Significant Disability (MSD).

The April 1, 2025, OOS is a wait-listing of customers who fall within the NSD and SD categories. Customers who are determined by OVR to fall within the MSD category will continue to receive OVR-funded services. Due to this being a partial OOS closure, OLTL participants who are requesting employment services/supports must continue to be referred to OVR for determination of eligibility.

Page three of the OLTL Employment and Employment Related Services Bulletin indicates that during a full OOS closure, “a participant who has not been referred to OVR may receive OLTL Home and Community-Based Services (HCBS) employment services without a referral to OVR.”

Due to the current OOS being a partial closure and not a full closure, participants still need to be referred to OVR for evaluation of eligibility for services. As detailed in the 1915 (c) waiver and page two of the Employment Services Bulletin, participants do not need to be referred to OVR for Benefits Counseling Services.

MCOs and SCs should continue to monitor cases referred to OVR as detailed on page three of the Employment Services Bulletin, which states, “Prior to adding one of the OLTL HCBS employment services to a participant’s Person-Centered Services Plan (PCSP), the SC must determine the status of the participant’s case with OVR.” Additionally, SCs should continue to follow the guidance on page two of the Employment Services Bulletin, which states, “If OVR has not made an eligibility determination within 120 days of a referral being sent, then OVR services are considered to not be available to the participant, and OLTL employment services may be provided under an OLTL HCBS program.”

PA Office of Vocational Rehabilitation’s (OVR) Executive Director Ryan Hyde has released a memo regarding OVR implementing an Order of Selection (OOS) beginning April 1, 2025.

As detailed in the memo, any questions about the OOS should be directed to the OVR inbox for OOS questions. Any customers with questions about how the OOS may impact your case, please contact your vocational rehabilitation counselor at your local OVR District Office.

The Office of Developmental Programs (ODP) has shared communication ODPANN 25-028 to clarify how the Office of Vocational Rehabilitation’s (OVR) Memo on March 15, 2025, regarding the Order of Selection and the OVR waiting list for services impacts referral requirements and access to ODP-funded employment services.

ODP and OVR will host a Virtual Office Hour on Monday, April 14, 2025, at 11:00 am. Interested parties are invited to join staff from both ODP and OVR to learn more about how the waitlist for OVR’s services may impact ODP’s employment services. There will be a short presentation with most of the time reserved for participants to ask questions to OVR and ODP staff. Harrisburg, PA — For the first time since 1994, the Pennsylvania Department of Labor & Industry (L&I) will reopen the order of selection (OOS) to significantly disabled (SD) and non-significantly disabled (NSD) individuals, terminating the waitlist for all SD and NSD applicants seeking vocational rehabilitation services. The change goes into effect today, August 8.

L&I’s Office of Vocational Rehabilitation (OVR) assists Pennsylvanians with disabilities in obtaining and retaining employment while keeping their independence. Since 2016, nearly 370,000 individuals have received services from OVR, including vocational counseling, evaluations, medical diagnostic services, medical restoration services, employment training, placement services, and career support services.

Under federal law, the OOS occurs when there are limited resources to provide vocational rehabilitation services. The OOS allows state vocational rehabilitation programs without adequate funding or staff to provide services to customers who qualify on a priority basis, by category. By law, the highest priority must be given to customers with the most significant disabilities.

“Every individual should have the opportunity to pursue their passion, earn a living wage and build wealth in Pennsylvania,” L&I Secretary Jennifer Berrier said. “OVR makes this possible for individuals with disabilities by connecting them to employers who wisely recognize the value of employing people with different backgrounds and experiences — and who make their workplace open to all through reasonable accommodation.”

Due to the decrease in economic activity during the pandemic, OVR has a surplus of federal funding available to remove the waitlist and use those unspent resources to serve more Pennsylvanians.

The removal of the waitlist for services expands participation in OVR services, along with more in-demand services, such as counseling and training. Over the last year, almost 55,000 individuals benefitted from those services.

“Our goal with this process has always been to serve people with disabilities by giving them the tools they need to obtain and maintain employment,” said OVR Acting Executive Director Ryan Hyde. “Removing the OOS allows us to serve more Pennsylvanians with disabilities, aiding them on their journey to be successfully and gainfully employed.”

Individuals currently on the waitlist for groups SD and NSD will be notified by their vocational rehabilitation counselors that they will be able to access services as of August 8. New, eligible customers seeking services in groups SD and NSD will be able to receive services without waiting. This change is effective through June 30, 2023, when OVR will review the fiscal outlook and decide whether the services to all groups can remain open, without the waitlist, beyond this date. On July 1, 2021, OVR reopened the OOS for individuals with a Most Significant Disability (MSD), eliminating the waitlist for any MSD applicants.

Determination of MSD, SD, or NSD is by the following criteria:

  • An individual with a most significant disability has a disability that results in serious functional limitations in three or more functional capacity areas.
  • An individual with a significant disability has a disability that results in serious functional limitations in at least one functional capacity area.
  • An individual with a non-significant disability is determined eligible for the OVR program but does not meet the MSD or SD requirements.
