PA Office of Vocational Rehabilitation

A special public meeting of the Office of Vocational Rehabilitation (OVR) Services Board was held on May 21, 2019. Secretary Jerry Oleksiak presented Shannon Austin to serve as the new Executive Director of OVR. The board of directors unanimously elected Ms. Austin to hold the position effective May 25, 2019.

Ms. Austin currently holds the position of District Administrator with OVR/Bureau of Blindness & Visual Services (BBVS) in Pittsburgh, Pennsylvania. At BBVS, she has been responsible for developing, implementing, and monitoring complex vocational rehabilitation programs in Vocational Rehabilitation, Independence Living for Older Blind, and Specialized Services Child. She strives to increase diversity and inclusion in the workplace and has been committed to creating and maintaining effective working relationships with employers, community partners, and professional organizations to address the needs of individuals with disabilities and minority communities. Ms. Austin expressed her desire to “move the needle in the state” to increase employment opportunities, including positions beyond entry level jobs, and promote movement of the ADA.

Secretary Oleksiak also took the time to thank Ryan Hyde for ten months of service as Acting Executive Director at OVR. Mr. Hyde served during a difficult time, particularly with the budgetary issues OVR is facing. The board members appreciate his efforts fulfilling these duties temporarily, in addition to his own position.

L&I Seeks Public Input on Proposed Changes to Pennsylvania’s Vocational Rehabilitation Services Plan

Harrisburg, PA – Department of Labor & Industry (L&I) Secretary Jerry Oleksiak today encouraged Pennsylvanians to provide comments on proposed changes to the state’s vocational rehabilitation services plan. Pennsylvania expects less federal reallocation funds for the vocational rehabilitation program and must adjust the plan.

“Our primary goal throughout this process is to ensure that services continue to be provided to as many people with disabilities as possible across the commonwealth,” said Secretary Oleksiak. “I urge interested Pennsylvanians to provide us with their feedback.”

Due to the anticipated decline in federal reallocation funds, the independent Pennsylvania State Board of Vocational Rehabilitation recently voted unanimously to begin the process to close the Order of Selection, in essence creating a temporary waiting list for new OVR customers. Services would continue for current OVR customers with an Individualized Plan for Employment, as well as Pre-employment Transition Services for students with disabilities, as required by federal law.

The proposal is available in the Pennsylvania Bulletin. Comments will be accepted for 30 days, until 5:00 PM on Tuesday, June 4, 2019, and should be emailed to [email protected], with “OOS closing all categories” in the subject line. Written comments may also be mailed to OVR Central Office, c/o Cindy Mundis, 1521 North 6th Street, Harrisburg, PA 17102.

Public meetings will be conducted in-person throughout the state in each OVR district office on Wednesday, May 22, 2019, from 3:00 PM to 4:30 PM and 5:00 PM to 6:30 PM. Individuals who are unable to attend in person can participate via phone. All meeting sites are accessible and interpreters for people who are deaf or hard of hearing will be present at each public meeting.

Following the public comment period, the U.S. Department of Education’s Rehabilitation Services Administration (RSA) will review OVR’s request to temporarily close the order of selection. If approved, the waiting list is expected to be implemented on July 1, 2019.

ODP Announcement 19-048 serves as notice that an updated version of the Office of Vocational Rehabilitation (OVR) Contact Information for ID/Autism Coordinators is now available.

On February 14, 2019, OVR and the Office of Developmental Programs (ODP) released Bulletin 00-19-01, OVR Referral Process for ODP Employment-Related Services. Attachment 4 to the bulletin is the OVR contact information for ID/Autism Coordinators; an updated version of this contact information can be found here. This version, dated 4/10/19, replaces Attachment 4 that was originally distributed with the bulletin.

Kristin Ahrens, Deputy Secretary for ODP and Ryan Hyde, Acting Executive Director for Office of Vocational Rehabilitation (OVR), signed a joint bulletin on February 14, 2019 to become effective on February 15, 2019. Bulletin 00-19-01 provides updated guidance regarding requirements for when individuals must be referred to OVR to align with the requirements in the current Consolidated Waiver, Person/Family Direct Support (P/FDS) Waiver, Community Living Waiver, and Adult Autism Waiver (the ODP Waivers), and the Workforce Innovation and Opportunity Act (WIOA) (Pub.L. 113-128) and clarifies that the guidance in this bulletin applies to employment-related services funded through base-funding provided for by the Mental Health and Intellectual Disability Act of 1966 (50 P.S. §§ 4101-4704).

In accordance with the Employment First Act (62 P.S. §§ 3401-3409), competitive integrated employment is the preferred outcome for individuals receiving services funded through the ODP Waivers or base-funding and OVR services. An employment outcome is the first and preferred outcome because it provides many benefits to the individual including, but not limited to: increased opportunities for economic self-sufficiency, an opportunity to contribute to the community, a chance to build a network of social relationships, and the creation of opportunities for lifelong learning. An employment outcome is also consistent with the overall goals and recommendations in Everyday Lives: Values in Action, the document that provides guiding principles for the Office of Developmental Programs (ODP).

The employment recommendation in Everyday Lives: Values in Action states: “Employment is a centerpiece of adulthood and must be available for every person. The benefits of employment for people with disabilities are significant and are the same as for people without disabilities.” In addition, Everyday Lives: Values in Action includes the following value statement developed by self-advocates: “I want to work and/or have other ways to contribute to my community. My family, supporters, and community support me to find and keep a real job that I like with good wages and benefits or start and run my own business, and/or volunteer the way I want in my community.”

ODP and OVR have been working closely together to ensure that all individuals enrolled in ODP Waivers or receiving base-funded services have access to experiences and services that will enable them to obtain an employment outcome and receive the benefits that come from being employed. Supports Coordinators must refer an individual to OVR for OVR to determine the individual’s eligibility for services when an individual who is enrolled in an ODP Waiver or is receiving base-funded services indicates an interest in seeking employment or requests that the following employment-related services be added to his or her Individual Support Plan (ISP):

Consolidated, P/FDS, and Community Living Waivers:

  • Advanced Supported Employment;
  • Supported Employment;
  • Small Group Employment;
  • Community Participation Support; and
  • Education Support.

Adult Autism Waiver:

  • Supported Employment;
  • Career Planning; and
  • Transitional Work.

All other services offered by the ODP Waivers do not require a referral to OVR.

Once an individual is referred to OVR, OVR will determine using its own eligibility standards and criteria if the individual is eligible for OVR services. OVR will not make a determination if employment-related services provided through ODP Waivers or base-funded services are needed or appropriate for the individual.

It is critical that OVR staff and Supports Coordinators engage in ongoing conversations during the OVR referral and eligibility determination process to ensure that timely eligibility determinations are made. Ongoing conversations allow OVR staff and Supports Coordinators to discuss the following topics:

  • Whether additional information is needed by OVR staff to make an eligibility determination.
  • If OVR staff has any concerns about the individual. For example, OVR staff may report that the individual has experienced a prolonged illness that has impacted OVR staff’s ability to set up meetings and determine the individual’s eligibility for OVR services.
  • The date that OVR staff expects to make an eligibility determination.
  • Services and supports that OVR staff is exploring with the individual.

In some circumstances, OVR may not have the capacity to serve every individual referred by a Supports Coordinator in a timely manner. In such cases, there are special provisions in the ODP Waivers that allow the Supports Coordinator to access Waiver funding without receipt of an OVR eligibility determination.

RCPA partnered with the Pennsylvania Client Assistance Program, PA APSE, and PAR to send a letter to OVR Acting Executive Director Ryan Hyde, Labor and Industry Secretary Jerry Oleksiak, Governor’s Secretary of Legislative Affairs Will Danowski, and Governor’s Secretary of Policy Meg Snead, expressing our serious concern regarding the January 10 memo, as well as actions taken by various OVR district offices, affecting funding of Pre-Employment Transition Services (PETS) in calendar year 2019.

Many providers of PETS services have reported the loss of funding for programs that were in place or about to launch at the beginning of 2019. This action has had a negative impact on a large number of students across the Commonwealth, as well as schools, teachers, families, and providers of services who have invested time and resources.
