A proposed regulation related to Adult Protective Services is currently posted on the Independent Regulatory Review Commission’s (IRRC) website. This proposed regulation “identifies mandatory reporters and prescribes penalties for their failure to report suspected abuse, neglect, exploitation, or abandonment; requires consistent and timely investigations of allegations; and when necessary, provides for protective services to mitigate risk to individuals.”

The public comment period has started and will end on May 22, 2023. Please take the opportunity to review the proposed regulation and submit any comments that you may have following the processes outlined within the timeframe allotted. Consider sharing your thoughts with Carol Ferenz or your policy division director by May 19, 2023, for inclusion in RCPA’s comments.

ODP Announcement 23-030 announces a 30-day public comment period on a proposal to expand funding made available to Administrative Entities (AEs)/Counties to support individuals and families on the waiting list to allow for pursuit of innovative strategies and provide alternatives to Community Participation Support (CPS) services.

Staffing shortages and the lingering impacts from the COVID-19 pandemic have led to a decrease in the availability of CPS services for some individuals. Spending for Respite and Family Support Services made available to individuals on the waiting list through the Home and Community-Based Services (HCBS) Spending Plan approved by the Centers for Medicare and Medicaid Services (CMS) is lower than projected in the majority of counties.

The Office of Developmental Programs (ODP) is requesting public comment on the following proposal that would allow AEs to repurpose unspent ARPA respite dollars to develop and fund innovative alternatives to traditional CPS. ODP will review and consider all comments received by 11:59 pm on April 10, 2023, in developing a final proposal for use of these ARPA funds. Public comment may be submitted through one of the following methods:

The Drug Enforcement Agency (DEA) is proposing to roll back flexibilities implemented during the public health emergency (PHE) in tele-prescribing buprenorphine. The proposed new regulation would mandate an initial in-person visit with a prescriber in order for a patient to receive more than a 30-day buprenorphine prescription. Since 2020, those with opioid use disorder have been able to receive prescriptions for buprenorphine, including the initial prescription, following a tele-appointment.

Patients who began buprenorphine treatment during the PHE under the expanded flexibilities would have a 180-day grace period but would then need to see a prescriber in person before continuing treatment under the DEA’s proposed rule.

The proposed rule and instructions for providing comments are available online. The public comment period closes March 31, 2023.

The PA Office of Vocational Rehabilitation (OVR) has developed a draft of the Driving & Vehicle Services policy. The draft will be posted on OVR’s website for public review beginning January 30, 2023. Virtual meetings will also be held via Zoom at 10 am and 3 pm on Thursday, February 16, 2023, to provide an overview of the policy and take questions and comments (content will be the same in both meetings).

The public is invited to comment on the draft policy for 30 days. Comments may be directed via email through February 28, 2023.

Public comments are being accepted until 11:59 pm on December 19, 2022. ODP Announcement 22-117 serves to announce a 30-day public comment period on the Residential and Community Participation Support (CPS) service locations that the Office of Developmental Programs (ODP) proposes to submit to the Centers for Medicare and Medicaid Services (CMS) for Heightened Scrutiny. Public comment on each service location will be accepted until 11:59 pm on December 19, 2022.

A summary of ODP’s findings for each Residential and CPS service location that ODP has determined meets one or more of these criteria is available at MyODP and DHS. A description of the process ODP used to identify service locations, complete reviews, and make determinations is also available on both websites.
