RCG

The Office of Mental Health and Substance Abuse Services (OMHSAS) is working on developing Regulatory Compliance Guides (RCG) for each licensed level of care to support their commitment to quality in licensing. The RCG is a tool for providers, OMHSAS staff, and the public to better understand the regulations.

This Regulatory Compliance Guide is a companion piece to 55 Pa. Code Chapter 5200. It is intended to be a helpful reference for these regulations. The explanatory material contained in this guide in no way supplants the plain meaning and intent of the regulations set forth in Chapter 5200.

OMHSAS issued the first version of the Psychiatric Outpatient Clinic RCG in November 2021. Today, they are reissuing an updated Psychiatric Outpatient Clinic RCG. The changes made were primarily to language and updates based on comments received on the original document.

ODP Announcement 23-020 announces missing content in the updated version of 55 Pa.Code Chapter 6400 Regulatory Compliance Guide, released on February 15, 2023. The Chapter 6400 Regulatory Compliance Guide released on February 14, 2023, in announcement 23-020, omitted 2 pieces of content, which are listed below:

  1. An opening narrative about compliance requirements in the Individual Rights section.
  2. Regulation 6400.103 that describes proper evacuation procedures in the First Safety section.

ODP Announcement 23-020 states that, since the release of Bulletin 00-20-01 Regulatory Compliance Guide for Community Homes for Individuals with an Intellectual Disability or Autism, the Office of Developmental Programs (ODP) has collected questions and comments from providers, licensing staff, and other stakeholders about how the Regulatory Compliance Guide (RCG) can be improved and updated. ODP has updated the RCG based on the feedback received and lessons learned through the inspection process and is pleased to announce the release of the updated Chapter 6400 RCG.

This version is effective as of February 14, 2023, and obsoletes the February 3, 2020, version of the RCG. A record of change showing the substantive changes made in the updated RCG is also available.

The Chapter 6400 Regulatory Compliance Guide, or RCG, was released for immediate implementation on February 3, 2020. ODP will be presenting a live webinar about the purpose of the RCG and how it will be used for applying and enforcing Chapter 6400. General information about why RCGs are used will also be presented.

This session is open to providers, advocates, Administrative Entities, Supports Coordinators, and all other interested parties.
