The Department of Human Services (Department) is making available for public review and comment the Office of Developmental Programs’ (ODP) proposed application for a section 1915(b)(4) waiver for a selective contracting program as well as amendments to the Consolidated and Community Living waivers required to implement selective contracting for Residential Habilitation, Life Sharing, and Supported Living services. The selective contracting program will be referred to as Performance-Based Contracting.
The Department is also making available for public review and comment additional proposed amendments to the Consolidated, Community Living, Person/Family Directed Support (P/FDS), and Adult Autism Waivers that are not related to implementation of selective contracting. Changes are proposed to become effective on January 1, 2025.
When performance-based contracting is implemented, all currently enrolled residential providers will have the opportunity to enter into a performance-based contract with ODP. To help support providers with the new requirements and process, ODP will hold provider trainings so that providers have a clear understanding of the process and expectations. As part of this process, providers will submit documentation demonstrating compliance with the performance areas identified by ODP. Additionally, ODP will use data from participant experience surveys, claims, incident management, health risk screening, administrative entities, and a new Performance Analysis Services vendor to evaluate each provider’s performance against the established standards and determine the tier in which the provider will be placed.

The Department proposes the following substantive amendments to the Consolidated and Community Living waivers that will support the implementation of performance-based contracting, effective January 1, 2025:
Supplemental payments will be calculated for residential providers meeting or exceeding performance standards as a one-time or combined payment up to 3% of ODP-eligible service revenue from the applicable review period or established payment amount per qualifying event. Providers that have been determined to be a Primary, Select, or Clinically Enhanced provider are eligible to receive the supplemental payments.

Comments received within 45 days of publication of this notice will be reviewed and considered for revisions to the proposed application for a section 1915(b)(4) waiver as well as proposed amendments to the waivers. The Pennsylvania Office of Developmental Programs (ODP) has informed us that they are preparing to release the proposed Performance-Based Contracting Waiver for public comment within the next two months, with adoption of the system in January 2025 for all residential service providers. Prior to January, all providers will be evaluated, determining which providers are considered primary, select, or meet the clinically enhanced standards.

As you are aware, The Pennsylvania Office of Developmental Programs (ODP) has proposed adopting a system under which private provider agencies would be graded on their performance on a number of ODP-selected indicators of quality. Underlying this model is the assumption that service providers should be able to offer all necessary supports and services to a broad range of individuals throughout their lives. In a sense, providers will be shaped towards becoming more comprehensive in their offerings.
RCPA is interested in assessing the extent to which the intellectual disability providers are prepared to meet these new expectations. By assessing readiness, we hope to be able to offer suggestions to ODP that will ease the transition to this new service model.

This is a reminder that RCPA will be holding the first meeting for our newly-established Performance-Based Contracting/Selective Contracting for ODP Services Work Group on Tuesday, January 16, 2024, from 1:00 pm – 2:30 pm.
As the Office of Developmental Programs (ODP) continues moving quickly on plans to migrate towards a performance-based contracting system, RCPA believes there is value in developing a work group for our members to keep informed and to prepare for future changes. We anticipate continuing to share news regarding any developments and updates from ODP and Strategic Thinking Work Group members both at these work group meetings and also in our IDD Committee meetings. More importantly, in this work group, we are encouraging discussion from members, with the goal of sharing thoughts and developing prudent strategies in order to prepare for performance-based contracting.
To begin this process, we will look at the proposed strategy from ODP and goals for the work group. As we move forward, we may determine it best to have meetings specific to Residential Services and Supports Coordination.
