In order to better serve our members and leverage our collective experience, the RCPA Diversity, Equity, & Inclusion (DEI) Committee is compiling a list of training and consultant recommendations on DEI-related topics. We kindly request that you share your organization’s experiences. If you have engaged in or utilized multiple trainings or consultants, please complete an additional survey for each one. RCPA will compile and post a repository of member recommendations.

ODP Announcement 24-071 informs stakeholders of the submission of the Performance-Based Contracting (PBC) 1915(b)4 Waiver and 1915(c) Waiver amendments to the Centers for Medicare and Medicaid Services (CMS). The Office of Developmental Programs (ODP) has included with this announcement multiple documents and resources that are essential for understanding and implementing PBC. The documents are:

Submitted amendments for Consolidated and Community Living 1915(c) and 1915(b)(4) Selective Contracting Waiver for Residential Services are available online. All significant changes resulting from public comments can be found in the PBC Implementation Guide under Appendix A, titled, “Significant Changes to Performance-Based Contracting Proposal as a Result of Public Comment April 20-June 4, 2024.”

As a reminder, all residential providers must sign and return the Residential Provider Agreement to ODP by July 31, 2024. Please direct any questions about this information to ODP electronically.

Deputy Secretary Ahrens of the Office of Developmental Programs (ODP) shared a PowerPoint today, July 25, 2024, at the MAAC meeting. Highlights included ODP’s plan to publish several documents. ODP will be submitting waiver amendments for the 1915(c) waiver and the new 1915 (b)(4) waiver to the Centers for Medicare & Medicaid Services (CMS) on July 26, 2024. In addition, ODP Bulletin 00-24-01: Performance-Based Standards for Residential Services and an ODP announcement regarding the waiver submission, including an implementation guide and provider self-assessment, will be released tomorrow, July 26.

RCPA will share these documents with members as soon as they are available.

The resources for the Administration for Community Living’s (ACL) Traumatic Brain Injury (TBI) Technical Assistance and Resource Center’s (TARC) June 2024 webinar Cognitive Impairment in Substance Use Disorder Treatment: Neurologic Informed Care are now available and posted on the ACL website. The resources posted include the webinar recording (captioned and available on YouTube) and webinar slides.

During the webinar, John D. Corrigan, PhD, ABPP, introduced the new American Society of Addiction Medicine (ASAM) expectations for the treatment of persons with cognitive impairment, including “Neurologic Informed Care,” as described in the new criteria. Implications for the identification of people in treatment who have a history of brain injury, as well as the use of accommodations to make treatment more accessible, were discussed.

Today, June 3, the Office of Developmental Programs (ODP) held the first of four Provider Preparedness Summits for Residential Services providers. The purpose of the summits are to take a deeper dive into the specifics that are being proposed for implementation of performance-based contracting (PBC).

The PowerPoint is now available, and a recording of the session will be posted shortly on the MyODP website.

ODP staff in attendance answered many questions submitted by providers. One of the key takeaways from today’s summit is that ODP will be postponing the due date for residential provider agreements to be signed and submitted to ODP. Originally, they were projected to be due by June 30, 2024; however, ODP has now stated that the due date will be July 31, 2024. The agreement has not yet been published, but it is expected to be released tomorrow, June 4, 2024.

There are three additional summits planned, and ODP will be recording each summit. Providers are encouraged to attend all four sessions as well as watch a pre-recorded webinar. All of these resources can be found on the MyODP website.
