MAAC

The agenda for the November 6, 2024, Long-Term Services and Supports (LTSS) Subcommittee meeting has been released by the Department of Human Services (DHS) Office of Long-Term Living (OLTL). The meeting will be held from 10:00 am – 1:00 pm in the Honors Suite, 1st floor, 333 Market Street, Harrisburg, PA 17126. Attendees have the option to attend in person or via webcast. Deputy Secretary Ahrens of the Office of Developmental Programs (ODP) shared a PowerPoint today, July 25, 2024, at the MAAC meeting. Highlights included ODP’s plan to publish several documents. ODP will be submitting waiver amendments for the 1915(c) waiver and the new 1915 (b)(4) waiver to the Centers for Medicare & Medicaid Services (CMS) on July 26, 2024. In addition, ODP Bulletin 00-24-01: Performance-Based Standards for Residential Services and an ODP announcement regarding the waiver submission, including an implementation guide and provider self-assessment, will be released tomorrow, July 26.

Today, both the ISAC Performance Review Subcommittee and the Medical Assistance Advisory Committee (MAAC) meetings were held. During these meetings, the Office of Developmental Programs (ODP) announced that as a result of public comments received regarding Performance-Based Contracting, some adjustments are being made to the plans. Tomorrow, ODP will release an announcement with more details, but for now, we know the following:

  • Residential providers will be offered a choice of when they are assigned into a tier. This will be based on which data they chose for ODP to review and make a tier determination upon. The choices will be:
    • Calendar year 2023 data reviewed with notification of tier assignment occurring in November, to be effective January 1, 2025 – June 2026; or
    • Review of Calendar year 2024 data with notification of tier assignment occurring in May, to be effective July 2025 – July 2026.

ODP plans to submit the proposed waiver to CMS on July 19, 2024.

The Deputy Secretary presented ODP updates at the Medical Assistance Advisory Committee (MAAC) meeting today, Thursday, April 25, 2024.

Updates included:

  • Performance-Based Contracting (PBC) 1915(b)(4) application, 1915(c) amendments, and Implementation Plan; and
  • Non-Performance-Based Contracting Waiver Amendment information.

ODP will publish provider preparedness tools that will include a Residential Provider Performance-Based Contracting Preparedness Assessment and hold provider forums to support providers as they get ready for PBC implementation. View the full presentation here.

The mission of the MLTSS Subcommittee is to be a resource to the Medical Assistance Advisory Committee (MAAC), enabling the Committee to advise the Department of Human Services (DHS) and OLTL on issues regarding access to services and quality of service.
